Privacy Policy

Language: The English version of this Privacy Policy is the authoritative version. Translations are provided for convenience only; if there is any conflict, the English version prevails.

Summary

Nexiter LIVE does not collect, store, or transmit any of your data to the developer. All data stays between your phone, BMW's servers, and ABRP's servers — services you already have accounts with and control independently. The one exception is the optional beta program: if you are a beta tester and choose to share diagnostic logs or complete the beta survey, that information is sent to the developer — see Beta Program below.

What Data the App Uses

BMW CarData Credentials

  • CarData Client ID, OAuth2 tokens
  • Stored: On your device only, using Android Keystore (hardware-backed encryption)
  • Sent to: BMW's servers for authentication only

Vehicle Telemetry

  • Battery state of charge (SoC), speed, charging status and power, estimated range, plus similar vehicle data BMW exposes when available
  • GPS location: sent to ABRP only if you turn off "Use phone GPS" in Settings. With the default setting (phone GPS on), the app sends no location — ABRP receives your position from your phone directly.
  • Source: BMW CarData streaming API — your own vehicle's data (MINI uses the same BMW CarData system)
  • Sent to: ABRP servers (api.iternio.com) under your ABRP account
  • Not stored: Forwarded in real time, not saved by the app

ABRP Credentials

  • ABRP token and API key
  • Stored: On your device only, using Android Keystore
  • Sent to: ABRP servers with each telemetry update

Trial Information

  • First launch date (to calculate trial period) and purchase status
  • Stored: On your device only
  • Not transmitted: Never leaves your device

App Logs

  • Technical messages: service status, connection state, errors
  • Stored: On your device only — never sent anywhere
  • Tokens and credentials are automatically redacted from logs

Beta Program (optional — beta testers only)

  • What: If you take part in the beta and choose to use "Share logs" or fill in the beta survey, you send the developer your app diagnostic logs (tokens and credentials automatically redacted) and, for the survey, your car model, phone model and Android version.
  • Opt-in: Nothing is sent automatically — it is sent only when you actively choose to share it. The general-release app sends nothing to the developer.
  • Used for: diagnosing bugs and improving device compatibility during the beta, nothing else. Never sold or shared with third parties.
  • Kept: only as long as needed to resolve the issue, then deleted.
  • Beta application form: if you apply for the beta on this website, the details you enter (name, email address, country, car model, phone model and your answers) are emailed to the developer and used only to review your application and run the beta program. The developer also keeps a minimal record of the acceptance or rejection email sent to you (date, address, which template). This data is used for nothing else and is never shared.

What We Do NOT Do

  • We do not operate any servers for the general-release app (the optional beta diagnostics above are the only exception)
  • We do not collect any data automatically — only what a beta tester explicitly chooses to send
  • We do not use analytics, tracking, or crash reporting services
  • We do not share data with any party other than BMW and ABRP (which you control)
  • We do not sell data

Third-Party Services

This app communicates with services you have chosen to use:

  • BMW CarData API (bmw-cardata.bmwgroup.com) — see BMW Group's privacy policy
  • ABRP / Iternio (api.iternio.com) — see Iternio's privacy policy

Data Deletion

All app data can be deleted by:

  • Using "Clear all data & reset" in Settings — removes all locally stored data
  • Uninstalling the app — removes all locally stored data

Note: Data previously sent to BMW or ABRP is governed by their respective privacy policies.

GDPR Information (EU)

The developer is based in Spain, so EU data-protection law (GDPR) applies. The sections below state the formal details the GDPR requires. Nothing here changes what is described above — it is the same facts, in the framework the law uses.

Lawful Basis for Processing (Article 6 GDPR)

  • Core app function (forwarding your vehicle data to ABRP): performance of a contract, Article 6(1)(b). The data forwarding is the service you install the app for — you configure and start it yourself, using your own BMW and ABRP credentials.
  • Optional beta log upload and survey: consent, Article 6(1)(a). Consent is given each time you choose to share, and you can withdraw it at any time (see Your Rights below).
  • Beta application and beta administration emails: steps taken at your request prior to and while taking part in the beta, Article 6(1)(b), based on the application you submit yourself.

Our Role

The developer operates no servers that touch your data. BMW Group and Iternio (ABRP) each act as independent data controllers for the data in your accounts with them, under their own privacy policies: BMW Group data protection and ABRP privacy notice. The app is a tool that runs on your device; the only personal data the developer can ever hold is a beta diagnostic log you choose to send.

Your Rights (Articles 15–21 GDPR)

You have the right to access, rectify, erase, restrict, and receive a copy of your personal data, to object to processing, and to withdraw consent at any time. In practice:

  • Data on your device: "Clear all data & reset" in Settings, or uninstalling the app, removes everything.
  • Data held by BMW or ABRP: exercise your rights directly with those services through your accounts with them.
  • Uploaded beta logs or beta application data: email nexiter@flax-creative.com and they will be deleted.

Retention

  • Data on your device: kept until you clear it or uninstall the app.
  • Beta diagnostic logs: deleted once the issue is resolved, and in any case no later than 90 days after upload, when they are deleted automatically.
  • Beta application data and the acceptance/rejection email record: deleted no later than 90 days after the beta program ends.

Supervisory Authority

You have the right to lodge a complaint with the Spanish supervisory authority, the Agencia Española de Protección de Datos (AEPD), www.aepd.es, or with the supervisory authority in your own EU country.
